§ 1 Subject matter and scope
These terms of service govern the use of the online service Leveo provided by Lukas Telbam, including the web dashboard, Discord bot, related interfaces, features, content, and other technical components of the service.
The service is intended for natural and legal persons who use the service themselves or on behalf of a community, organisation, or server.
Where individual features are provided or used via third-party platforms, their terms apply additionally, in particular the terms and policies of Discord and Roblox and, where applicable, other integrated third-party providers.
§ 2 Conclusion of contract and requirements for use
By signing in via Discord or Roblox and subsequently using the service, a free user relationship is formed between you and Lukas Telbam under these terms of service.
Sign-in and use require a Discord or Roblox account. You must be authorised to use that account and to complete the respective connection.
If you use the service for an organisation, team, server, or other third parties, you represent that you have the required authority to do so.
You may only use the service if you meet the age requirements under applicable law and the rules of the respective platform used.
§ 3 Free provision of the service
The service is currently offered free of charge.
There is no entitlement for the service to remain free permanently. Lukas Telbam may introduce paid features, plans, or additional services in the future. Existing free use does not automatically become paid solely through these terms; paid services require a separate agreement or other legally permissible basis.
§ 4 Scope of services
Lukas Telbam provides the service in its respective current functional scope.
The service is provided as a free offering. Subject to mandatory statutory rights, there is no entitlement to a particular quality, specific features, uninterrupted availability, error-free operation, compatibility with particular third-party platforms, data migration, permanent data storage, data restoration, or individual support.
Information on websites, in documentation, changelogs, roadmaps, FAQs, Discord servers, or other communication channels constitutes a binding service commitment only if expressly designated as binding.
§ 5 Permitted use
You may use the service only in accordance with these terms of service, applicable laws, and the rules of the respective integrated third-party platforms.
In particular, you must not
- use the service abusively, unlawfully, fraudulently, in a harassing manner, or in a way that endangers security,
- circumvent or impair technical safeguards, rate limits, access restrictions, or security mechanisms,
- deploy malware, automated attacks, spam, scraping, credential attacks, or comparable interference,
- infringe third-party rights, in particular copyright, trade mark, personality, or data protection rights,
- submit, process, or distribute content or input whose use is unlawful or for which you lack the required rights,
- use the service in a way that materially impairs Discord, Roblox, other third-party platforms, other users, or Lukas Telbam's technical infrastructure.
§ 6 User content and responsibility
Where you transmit or process content, input, configurations, messages, form entries, applications, tickets, file uploads, or other information via the service, you remain responsible for their lawfulness, accuracy, and permissibility.
You represent that you hold the required rights to such content and that its use within the service is permitted.
Where necessary for operation, provision, error analysis, abuse prevention, moderation, IT security, legal enforcement, or compliance with legal obligations, you grant Lukas Telbam a simple, non-exclusive, non-transferable licence to the content you transmit, limited to the term of the user relationship and to the extent required for these purposes.
§ 7 Changes to the service and terms of service
Lukas Telbam may develop the service at any time and change, add, restrict, or remove features, content, technical processes, integrations, procedures, rules, and usage requirements where there is good cause. Good cause exists in particular for legal requirements, security requirements, abuse prevention, technical development, changes to third-party platforms or APIs, economic reasons, or adaptation to user needs.
Lukas Telbam may discontinue the service in whole or in part temporarily or permanently. Where possible and reasonable in the circumstances, prior notice will be given with an appropriate period.
Where mandatory law provides additional information, consent, or termination rights for changes that are disadvantageous to you, these remain unaffected.
Lukas Telbam may also amend these terms of service with future effect where required for good cause. Amended terms will be communicated in an appropriate form. Where express consent is legally required for individual changes, it will be obtained separately.
§ 8 Access restrictions, suspension, and exclusion
Lukas Telbam may take measures where necessary to protect the service, other users, third-party platforms, or Lukas Telbam's legitimate interests. Measures include in particular notices, warnings, feature restrictions, rate limits, deletion or deactivation of individual content or configurations, temporary suspension, and permanent exclusion from use.
Measures may be taken in particular where
- you breach these terms of service, applicable law, or third-party rights,
- there is suspicion of abuse, fraud, security incidents, or impermissible automation,
- your conduct endangers the stability, security, or integrity of the service or connected systems,
- you provide false, misleading, or incomplete information,
- requirements or measures of Discord, Roblox, or other integrated third-party platforms make this necessary,
- official or court orders require it, or
- there is another important reason.
In urgent cases, in particular ongoing abuse, security risks, imminent danger, or to protect Lukas Telbam's legitimate interests, a measure may be taken without prior notice. Where legally required and actually possible, the affected person will be informed afterwards.
There is no entitlement to a warning, a particular escalation stage, unblocking, readmission, or “unban”. Lukas Telbam may voluntarily review substantiated review requests. Mandatory rights to reasons, complaint, review, or judicial remedy remain unaffected.
§ 9 Termination of the user relationship
You may stop using the service at any time and end connections to Discord and Roblox.
Lukas Telbam may terminate the user relationship at any time with future effect where there is good cause or where the service is discontinued in whole or in part. The right to immediate suspension or termination for important cause remains unaffected.
After termination of the user relationship, Lukas Telbam may restrict or end access to the service and to stored data, settings, or content, unless statutory obligations or mandatory rights oppose this.
§ 10 Third-party platforms and external services
The service may wholly or partly rely on or interact with third-party services, in particular Discord and Roblox as well as other hosting, infrastructure, identity, or API services.
Lukas Telbam has no influence over the permanent availability, functionality, change, or discontinuation of such third-party services. Changes, restrictions, or outages of such third-party services may impair usability of the service wholly or partly.
Third-party offerings are governed exclusively by the terms and privacy information of the respective third-party provider.
§ 11 Privacy
Personal data is processed in accordance with Lukas Telbam's separate privacy policy, available at: Privacy Policy.
These terms of service do not comprehensively govern data protection processing of personal data. Statutory data subject rights remain unaffected.
§ 12 Liability
Lukas Telbam is fully liable for intent and gross negligence and for damage arising from injury to life, body, or health.
For simple negligence, Lukas Telbam is liable only for breach of an essential contractual obligation; in that case liability is limited to foreseeable, typical contractual damage.
Otherwise, Lukas Telbam's liability is excluded to the extent permitted by law.
Mandatory statutory liability provisions, in particular under product liability law or mandatory consumer law, remain unaffected.
Where the service is provided free of charge, Lukas Telbam — subject to the preceding sentences — additionally assumes no liability for outages, data loss, functional interruptions, compatibility problems, third-party provider changes, or the discontinuation of individual features.
§ 13 Choice of law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer with habitual residence in another state of the European Economic Area, mandatory consumer protection provisions of that state remain unaffected.
If the user is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these terms of service is Wuppertal. Otherwise, statutory places of jurisdiction apply.
§ 14 Final provisions
If any provision of these terms of service is or becomes wholly or partly invalid, the validity of the remaining provisions remains unaffected unless the law provides otherwise.
Individual agreements between Lukas Telbam and individual users take precedence over these terms of service where expressly agreed in writing or in text form.
